Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). Icon Swim does not permit the retail reselling our exclusive styles.
You must not transmit any worms or viruses or any code of a destructive nature.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

Icon Swim’s discounts and sale markdowns are based on Icon Swim’s value of the product. This price is not intended to reflect a former price for which this product has sold in the past. The product amount represents Icon Swim’s full retail value of the product for this present day after consideration of many factors. Before checking out, every customer must check they acknowledge and have read our terms and conditions before proceeding to checking out.
SECTION 6 - PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. Except as otherwise stated in these Terms, none of the material may be reproduced, distributed, republished, downloaded, displayed, posted, transmitted, or copied in any form or by any means, without the prior written permission of Icon Swim, and/or the appropriate licensor. Permission is granted to display, copy, distribute, and download the materials on this Site solely for personal, non-commercial use provided that you make no modifications to the materials and that all copyright and other proprietary notices contained in the materials are retained. You may not, without Icon Swim’s express written permission, 'mirror' any material contained on this Site or any other server. Any permission granted under these Terms terminates automatically without further notice if you breach any of the above terms. Upon such termination, you agree to immediately destroy any downloaded and/or printed materials. SECTION 22- SUBMISSION OF CONTENT; COMMENTS, IMAGES, VIDEOS AND OTHER CONTENT
For any content you provide to Icon Swim, on or by the Site, or otherwise disclose, submit or offer in connection with your use of this Site or other websites such as Facebook or Instagram that may interact with this Site, including comments, ideas, images, photographs, video clips, audio clips, graphics, tags, data, materials, information, and other submissions, including submissions with any hashtags such as #iconswim or #icondoll (collectively, 'User Content'), you specifically grant us a non-exclusive, transferable, sub-licensable, royalty-free, fully paid up, worldwide license (but not the obligation) to use any User Content that you post on or in connection with Icon Swim (“IP License”). The IP License includes, for example and without limitations, the right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, in both digital and physical owned channels, and will not be limited in any way in its use or modifications to the submission, whether for commercial purposes or not, of the User Content. In certain circumstances, Icon Swim may also share your contribution with trusted third parties. You are also granting us a non-exclusive, transferable, sub-licensable, royalty-free, fully paid up, worldwide license (but not the obligation) to use your name, likeness, personality, voice, or any other materials or information you provide to Icon Swim in connection with your content.
Icon Swim is not and shall not be under any obligation (1) to maintain any User Content in confidence; (2) to pay you any compensation for any User Content; (3) to credit or acknowledge you for User Content; or (4) to respond to any User Content.
You understand and agree that it is your obligation to make sure the User Content you submit to the Site must not violate the rights of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). By participating in Site sweepstakes, contests, promotions, and/or requesting promotional information or product updates, you agree that Icon Swim may use your information for marketing and promotional purposes.
When you publish content or information using the “Public” setting, it means that you are allowing everyone, including other Website users, to access and use that information, and to associate it with you (i.e. your name and profile picture). We advise that you never reveal any personal information about yourself or anyone else (telephone number, home address, business address, delivery address or email address or any other details that would allow you to be personally identified).
If you do not want to grant Icon Swim the permission set out above on these terms, please do not submit User Content.
SECTION 23- ICON SWIM MOBILE TEXT MESSAGING TERMS AND CONDITIONS
By subscribing to text marketing notifications you agree to receive recurring automated marketing messages and shipping cart reminder messages at the phone number provided. Consent is not a condition of purchases. Reply STOP to unsubscribe. HELP for help. Msg & Data rates may apply. For more info view ToS. We determine cart abandoned by using a cookie and check whether the existing user has already opted in for text marketing. If you do not wish to be part of our service you can unsubscribe at any time by texting STOP, CANCEL, QUIT, END, or UNSUBSCRIBE to any mobile message received from us. You may get another text message confirming your unsubscribing from our service. You waive any rights to bring claims for unauthorized or undesired text messages by failing to opt-out immediately. The program is only available to customers of select carriers with compatible handsets. You also agree that by sending an email, calling in, or sending any other means of opt-out unsubscribe request or using words different than the ones presented above will not be reasonable means to unsubscribe you. When you opt-in for our service you may expect to get occasional texts concerning the latest Text Alerts, Surveys, Welcome messages, Customer win-backs, Text Campaigns, Giveaways, Flash Sales, Upsells. Our sms messages will not exceed 6 monthly messages. If your device does not support MMS we will deliver an SMS instead and strip the image. The opt-out will also be delivered as a standard text message (SMS)Carriers (AT&T, T-mobile, Verizon, T-Mobile, Sprint, Rogers, MetroPCS, etc) are not responsible or liable for undelivered or delayed messages.
You also permit Icon Swim to use location information (e.g., GPS) from your mobile device when you are in or near a pop-up shop event and to send you additional messages based on your location. These location-based messages, together with our other mobile alerts, may exceed the 6 monthly automated text messages referenced above.
By subscribing to our program, you confirm that you are the current subscriber and/or customary user of the mobile number registered and authorized to incur any message or data charges that may be charged by your mobile carrier. You are strictly prohibited from registering a mobile number that is not your own. If we discover that any information provided in connection with your subscription is false or inaccurate, we may suspend or terminate your access to the program at any time. You understand that you do not have to sign up for this program in order to make any purchases (in-store or online), and your consent is not a condition of any purchase with Icon Swim. Your participation in our alerts program is completely voluntary.
If you relinquish ownership of the mobile number associated with your subscription, you agree to immediately notify Icon Swim by texting STOP or by emailing info@iconswim.com. You agree to indemnify Icon Swim for any privacy, tort or other claims, including claims under the Federal Telephone Consumer Protection Act or its state law equivalent, relating to your provision of a mobile number that is not owned by you and/or your failure to notify Icon Swim of any changes in mobile ownership. You must notify Icon Swim immediately of any breach of security or unauthorized use of your mobile device. Although Icon Swim will not be liable for losses caused by any unauthorized use of your mobile device, you may be liable for the losses of Icon Swim or others due to such unauthorized use. If you get a new mobile number, you will need to sign up for the program with your new number.
The program is free, but the message and data rates may apply from your carrier. Check your mobile plan and contact your mobile carrier for details. You are responsible for obtaining and maintaining all mobile devices and other equipment and software, and all internet service provider, mobile service, and other services needed to access and use the program, and you are solely responsible for all charges related to them, including charges from your mobile carrier.

SECTION 24- ICON SWIM’S COMMUNICATIONS TO YOU
You agree that Icon Swim may send electronic mail to you for the purpose of advising you of changes or additions to this Site, about any of Icon Swim’s products or services, or for such other purpose(s) as Icon Swim deems appropriate.
